1. Agreement to Terms

By accessing and using the Fireflies Collective website and services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

2. Services

Fireflies Collective provides art direction, brand identity, digital design, illustration, print and packaging design, and motion design services. All project scopes, deliverables, timelines, and fees will be outlined in individual project proposals and contracts.

3. Intellectual Property

Unless otherwise agreed in writing, upon full payment, the client receives full ownership of the final approved deliverables. Fireflies Collective retains the right to display completed work in our portfolio and marketing materials unless a non-disclosure agreement is in place.

All preliminary concepts, drafts, and unused designs remain the property of Fireflies Collective.

4. Payment Terms

Our standard payment structure is 50% upon project commencement and 50% upon delivery of final files. For larger projects, we may propose milestone-based billing. All invoices are payable within 30 days of receipt.

5. Revisions

Our project proposals include a specified number of revision rounds. Additional revisions beyond the agreed scope will be billed at our standard hourly rate, which will be communicated in advance.

6. Confidentiality

We treat all client information with strict confidentiality. We will not share your proprietary information with third parties without your explicit consent, except where required by law.

7. Limitation of Liability

Fireflies Collective's total liability for any claims arising from our services shall not exceed the total amount paid by the client for the specific project in question.

8. Cancellation

Either party may terminate a project with 30 days' written notice. In case of cancellation, the client is responsible for payment of all work completed up to the date of termination.

9. Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

10. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to update these terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the new terms.
